73 Fed. Reg. 61332 (October 16, 2008)
USCIS issued a final rule, effective October 16, 2008, increasing to three years the period of initial admission and extension of stay that can be requested by a TN nonimmigrant under NAFTA. Prior to this rule change, the maximum period of admission or extension of stay was one year at a time.
In order to take advantage of the new three-year TN, individuals will need to either:
(1) Apply for a three-year TN at the border or applicable airport (CBP now has the authority to process and issue TNs valid for three years); or
(2) Request a three-year TN extension by filing an I-129 petition with USCIS, which has jurisdiction over I-129 petitions requesting TN visa status.
